The lawsuit of Roger C. S. Lin et. al. v. United States of America proceeds from the premise that native Taiwanese people are not correctly classified as having “Republic of China nationality.”
An initial judicial victory was obtained in the US District Court, District of Columbia, on March 18, 2008, when the court ruled that native Taiwanese people have essentially been persons without a state for over sixty years.
This case is now continuing in the US Court of Appeals, and Oral Arguments were held on Feb. 5, 2009. The Court is expected to render a decision in May or June 2009.
